House District 46 Race

(Waldron, AR) —Gun Owners of Arkansas believes it is our responsibility to alert voters in House District 46 about our concerns regarding Candidate Curtis Varnell. In responding to the Family Council survey on Red Flag laws, Mr. Varnell expressed his support for them, provided there is judicial approval. While this might initially seem reasonable, it becomes troubling when considering that many judges hold anti-gun views. One example is the Judge and Prosecutor in Lonoke County in the Aaron Spencer trial and the Arkansas Supreme Court removed her from the presiding.

The Constitution clearly states that no person shall be “deprived of life, liberty, or property without due process of law.”

Statement directly from Mr. Varnell concerning Red Flag Laws:

“The State should have some control on gun possession if a person is deemed mentally incompetent or a danger to the public. The ability to restrict should require specific evidence of danger and approved by a Judge, similar to a warrant.

With judgmental approval only”

Taking property from individuals who have not been found guilty of any crime contradicts this fundamental principle. Proponents of gun control argue that due process is maintained because those whose firearms are seized have the option to appeal and recover their property. Yet, this flawed approach suggests that the Second Amendment is a privilege rather than a guaranteed right.

Removing a constitutionally protected right from individuals without criminal charges or a trial is a direct violation of civil liberties.
